Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Fazey ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you confirm you have your parent or guardian's permission to use the App and to accept these Terms.

3. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, for personal non-commercial use only.

4. User Content

You retain all ownership rights to photos and other content you upload ("User Content"). By uploading User Content, you grant us a worldwide, royalty-free, non-exclusive license to process, transform, store temporarily, and return that content to you for the sole purpose of delivering the App's features.

We do not use your User Content to train AI models. We do not share your User Content with third parties except as required to deliver the requested transformation through our AI provider, and only for the duration needed to process the request.

You represent that you have all necessary rights to upload any User Content and that it does not violate any third-party rights or applicable laws.

5. Prohibited Uses

You agree not to use the App to:

Upload images of minors without lawful consent
Create content that is defamatory, harassing, hateful, or sexually explicit
Impersonate others or create deepfakes intended to deceive
Violate any applicable law, regulation, or third-party right
Reverse engineer, decompile, or attempt to extract source code from the App
Use automated systems to access the App, except as expressly permitted

6. Subscriptions & Billing

6.1 Free Tier

The App offers a free tier with limited features. You may use the free tier without payment.

6.2 Pro Subscription

The App offers paid subscription tiers ("Pro") billed through Apple's App Store. Pricing is displayed in-app at the time of purchase. Subscriptions auto-renew at the end of each period unless cancelled at least 24 hours before renewal.

6.3 Free Trial

If a free trial is offered, you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin and you will be charged the standard subscription price.

6.4 Cancellation & Refunds

You may cancel your subscription at any time through your Apple ID account settings. Refunds are handled by Apple under their refund policy; we do not directly process refunds.

7. Intellectual Property

The App, including its design, code, branding, prompts, and trained outputs (excluding User Content), is owned by us or our licensors and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

8. AI-Generated Content Disclaimer

AI-generated outputs are produced by third-party machine learning models and may contain inaccuracies, artifacts, or unintended results. The App is provided for entertainment and creative purposes. We do not warrant that outputs are accurate, fit for a particular purpose, or free of error.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising out of your User Content or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice, for conduct that we believe violates these Terms or is otherwise harmful.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of [YOUR JURISDICTION — e.g., State of California, USA], without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction.
